The court found that the International Emergency Economic Powers Act (IEEPA) does not authorize the president to impose such broad tariffs without congressional approval.
This decision is a victory for small businesses that challenged the tariffs, including Vermont-based Terry Precision Cycling, a women’s cycling apparel company. Terry Cycling argued that the tariffs imposed severe financial burdens, threatening their survival. The court’s ruling underscores the importance of checks and balances in trade policy and affirms that unilateral tariff impositions without legislative backing are unconstitutional.
We’re particularly stoked to see a cycling brand like Terry leading the charge in defending small businesses and the cycling industry against overreaching trade policies.
